Wisconsin Casino Lawsuit Sent Back to Court

WISCONSIN – As reported by the Wisconsin Capital Times: "A legal challenge to the continuation of Indian casinos is back in the state Supreme Court.

"In a ruling handed down this morning, the 4th District Court of Appeals urged the high court to take up the case, calling the challenge by the owners of a Kenosha dog track 'unquestionably ... one of paramount statewide importance.' It certified the case, effectively asking the high court to take up the matter.

"In the challenge, the dog track owners contend that the 1993 amendment to the Wisconsin Constitution limiting gambling withdrew the ability of the state to extend the gambling agreements with the Indian nations in Wisconsin.

"…In referring the case back, the appeals court noted that the Supreme Court has since ruled in a challenge to expanding games at the casinos and there has been a change in the high court makeup…"
