Wisconsin Casino Case Sent Back

WISCONSIN – As reported by the Wisconsin Capital Times: "The state Supreme Court today split 3-3 on a lawsuit that could have triggered closing American Indian casinos in Wisconsin.

"The high court remanded the case to the 4th District Court of Appeals for further consideration. Earlier, Dane County Circuit Judge Richard Callaway had ruled a 1993 constitutional amendment wasn't intended to halt casino gaming.

"Owners of the Dairyland dog track at Kenosha brought the suit, claiming the gambling curbs in the 1993 amendment had made the casinos illegal. The lawsuit also was aimed at blocking Gov. Jim Doyle from entering into new compacts with the 11 American Indian nations in the state.

"…Normally cases go from Circuit Court to the appeals court before going to the Supreme Court. This case, however, went directly from Callaway to the Supreme Court, and it now is being sent back to the appeals court…"
