West Virginia Video Poker Signs Can't Say 'Casino'

WEST VIRGINIA -- As reported by the Associated Press: "Gov. Bob Wise signed an executive order Wednesday that prohibits bars, clubs and fraternal groups from using the word ''casino'' and other gambling-related words or images when advertising video poker games.

"Wise said his order closes a loophole in legislation that allows the state-controlled limited video lottery machines to be played in certain adult-only venues.

"In April 2001, at Wise's urging, lawmakers passed the Limited Video Lottery Act to allow 9,000 video poker machines in bars, private clubs and other adult settings. The goal was to eradicate similar 'gray machines' that had operated for years without regulation or taxation in places accessible to children.

"But as the licenses are sold, the clubs are changing the landscape in parts of West Virginia, with many declaring themselves 'casinos' on large outdoor signs.

"...Though the law prohibits advertising the machines, club owners skirt that by posting the name under which the business has incorporated -- usually featuring a gambling theme.

"The state Lottery Commission has been working on regulation changes to address the issue, but Wise believes the intent of the current law is clear, spokeswoman Amy Shuler Goodwin said.

"...The governor's order says retailers who want to operate the terminals after Jan. 1, 2004, 'shall not use a name that contains any word or wording commonly associated with video lottery ... or use symbols commonly associated with video lottery and/or gambling/gaming in any advertising, promotional materials or on any exterior/outdoor signage.'

"Club owners who do not follow the order could lose their licenses and be fined. Notices will be sent to all operators this week..."
