West Virginia Group Appeals Casino Decision19 January 2005WEST VIRIGNIA -- As reported by the Weston Democrat: "Late last week, members of the Lewis County Coalition Against Gambling Expansion and the Lewis County Ministerial Association filed an appeal with Lewis County Circuit Clerk John Hinzman's office that was to be sent to the West Virginia Supreme Court in regards to continuing action concerning a proposed plan to turn the now closed Weston State Hospital into a resort and casino. "Arguments included in the appeal are that the foes of gambling believe the Circuit Court erred in granting the motion to dismiss based on a ruling that their suit was untimely filed and that the Circuit Court erred in granting a notion to dismiss based on its finding that the casino referendum at issue was properly placed on the November 2, 2004 ballot by the Lewis County Board of Ballot Commissioners. "The anti-gambling groups have asked for Circuit Judge Thomas Keadle's decision to be overturned because they believe the original lawsuit was 'timely filed.' "…According to the groups filing the appeal, they believe the vote was illegal because the ballot referendum was improperly worded and the Weston State Hospital does not meet the criteria to qualify as a 'historic resort hotel.' "…According to anti-gambling groups, the name of the hotel must be included on the ballot but the ballot only noted the Weston State Hospital as a location for the proposed gambling outlet…" |
