Verdict Expected for Texas Video Casino Case

TEXAS – As reported by the Texas Brownsville Herald: " After one and half days of testimony, a jury is expected to render a verdict today in what prosecutors call the first criminal trial in a Cameron County court against a video casino.

"Both the owner and manager of the Lucky Spin Arcade appeared Wednesday and Thursday in County Court at-Law No. 2 to face charges of violating state gambling laws.

"The video casino, located at 1607 Price Road, was raided by Brownsville police on Aug. 5 following an undercover investigation.

"Owner Elwyn Leroy Herman, 65, and manager Guadalupe Rocha, 41, were arrested and charged with three misdemeanor charges of keeping a gambling place, gambling promotion and possession of a gambling device.

"Defense attorneys contend that the operation was legal and only gave out prizes that included household items such as peanut butter, coffee and paper towels valued at less than the $5 legal limit.

"…If convicted, both Herman and Rocha could face up one year in jail and/or a $4,000 fine for each charge…"
