U.S. Court Rejects Iowa's Tax Case

IOWA – As reported by the Des Moines Register: "The U.S. Supreme Court has rejected without comment Iowa's request to hear arguments over the way the state taxes its casinos.

"Iowa Attorney General Tom Miller asked the court to hear an appeal of the Iowa Supreme Court's decision that the state's way of taxing racetracks and riverboat casinos was unconstitutional.

"…'We're pleased that the litigation is over,' said Mark McCormick of Des Moines, the attorney for the Racing Association of Central Iowa, which represents Prairie Meadows Racetrack and Casino in Altoona.

"The association sued the state claiming its two-tiered system unfairly taxed land-based casinos by taxing them at a higher rate than riverboat casinos. The lawsuit asked the state to pay the land-based casinos $112 million in refunds.

"It's the second time the case was sent to the U.S. Supreme Court…"
