Tropicana Sued by Neighbor Over Collapse30 July 2004ATLANTIC CITY, New Jersey – As reported by the Press of Atlantic City: "The owner of a business located near the Tropicana parking garage that collapsed in October filed a lawsuit Thursday requesting all businesses that lost profits because of the accident and experienced other problems join in a suit against those responsible. "Another Time Inc., trading as Chelsea Pub & Hotel and John Conway, filed the lawsuit against the Tropicana Casino and Resort and others, including Fabi Construction Inc., the concrete subcontractor for the parking garage, and Keating Building Corp., the lead contractor for the project. "According to the complaint, Conway, the owner of the restaurant and hotel located at 8 S. Morris Ave. for 24 years, is charging that the companies showed reckless disregard and negligence, and willful disregard for the safety of the public while constructing the garage. Since the collapse, the business owners surrounding the site have suffered economic hardship, and continue to suffer uninsured and un-reimbursed property damage and loss of revenue. "…Businesses near the collapse closed until Nov. 1. But when the businesses were allowed to reopen, access on the block near the garage was closed, limiting the number of potential customers for the stores. "The lawsuit, includes a negligence count, private and public nuisance counts, and punitive damages as a result of the defendants' alleged deliberate indifference to the substantial loss of use, enjoyment and value of the Conway's property and of other area businesses surrounding the garage…" |
