Tropicana motion denied

TLANTIC CITY, New Jersey -- (PRESS RELEASE) -- Capping off a bad week for Tropicana Entertainment LLC, a federal judge from the US District Court for New Jersey today refused Tropicana's motion to issue a temporary restraining order against UNITE HERE Local 54, the casino workers union which represents 15,000 workers in Atlantic City.

"The fact that the Tropicana filed this lawsuit just shows that they can't stand the facts being reported," said Bob McDevitt, President of Local 54. "No strike clauses are not gag orders. We have a constitutional right to raise issues that are of critical importance to our members, the city and the State of New Jersey and to participate in the regulatory process."

"Clearly, the judge agreed with us and denied the Tropicana's desperate and frivolous attempt to deny us our basic rights," added McDevitt.

One of the several lines of evidence Local 54 has advanced is that massive job cuts at the Tropicana has hindered the casino's ability to maintain a "superior, first-class facility" as required by the Casino Control Act. On Thursday, Local 54 was granted participant status in the upcoming re-licensing hearings which will begin next week.

On Tuesday, Tropicana held their third-quarter earnings call in which they announced that revenues declined 10% compared with the previous year and that the company had violated one of the terms of its credit facility.

On Wednesday, the City Council of Atlantic City unanimously passed a resolution calling on the Casino Control Commission to uphold the provisions of the Casino Control Act when considering Tropicana's licensing.

On Thursday, S&P downgraded Tropicana Entertainment's senior secured credit facility to negative. In addition, Tropicana lost their attempt to bar Local 54 from the licensing hearings and to exclude consideration of whether the Tropicana runs a "first-rate superior facility."
