According to the Marin Independent Journal, 90-year-old Jay Leone was tied up and was being robbed by 31-year-old meth user Samuel Cutrufelli when he managed to escape. He got a gun and, after being hit by a shot from Cutrufelli in the jaw, returned fire, hitting Cutrufelli. And THAT'S why he's being sued. For returning fire on a man that had broken into his home, tied him up, attempted to rob him and shot him in the face.
