Supreme Court Petitioned to Review N.Y. Casino Ruling

NEW YORK – As reported by the New York Business Review: "Anti-casino forces have asked the U.S. Supreme Court to review a May 2005 ruling by the state's highest court upholding a state law permitting Native Americans to run casinos in New York.

"The Court of Appeals in May ruled that the federal Indian Gaming Regulatory Act gives tribes the power to operate casinos even if the state Constitution explicitly prohibits casinos in New York.

"The Court of Appeals' ruling upheld a series of new gambling ventures the state approved in October 2001. At the time, state officials were seeking new revenues in the wake of the Sept. 11 terrorist attack that destroyed the World Trade Center towers…"
