Sentence for $19 Million Theft Stays

AUSTRALIA – As reported by the Australian: "Western Australia's top prosecutor has failed in a bid to double the jail term of a bank manager who stole almost $19 million to feed an online gambling habit.

"WA's Director of Public Prosecutions Robert Cock had appealed against the five-year sentence handed to Kim Faithfull, who stole $18,995,212.95 over five years from the Commonwealth Bank in Karratha.

"…The thefts only came to light after Faithfull, apparently on the brink of suicide, left a note for his staff admitting his crime.

"Faithfull was sentenced to five years on one count of theft as a general deficiency, and three years on another, to be served concurrently.

"The DPP had claimed that the sentencing District Court justice, Chief Judge Kevin Hammond, had erred by making the sentences concurrent.

"But in a judgment handed down in the WA Supreme Court of Criminal Appeal today, Justices Christine Wheeler and Carmel McClure and Chief Justice David Malcolm dismissed the appeal, saying the sentence was appropriate…"
