Rincon Lawsuit Denied

LOS ANGELES, California – As reported by Reuters: "A U.S. District Court Judge on Wednesday denied a motion to stop the expansion of slot machine gambling on California Indian reservations in a victory for Gov. Arnold Schwarzenegger.

"The Rincon tribe had argued in a suit filed last month that deals between the state and five other tribes that would allow an unlimited number of slot machines in exchange for tribal contributions to the state budget threatened smaller tribal casinos.

"But Judge Thomas Whelan in a 16-page ruling from San Diego said that the state and the governor did not have a duty to consider other tribes' interests when making agreements.

"Whelan denied motions for a temporary restraining order on the expansion, for a preliminary injunction hearing, and for expedited discovery in the case.

"…Rincon lawyer Scott Crowell said the tribe would consider an emergency appeal to the U.S. Ninth Circuit of Appeals…"
