Prosecutors to Seek Life Sentence for Alleged Binion Killers19 December 2003LAS VEGAS – As reported by the Associated Press: "Prosecutors plan to seek a harsher penalty for Sandy Murphy and Rick Tabish if they are convicted a second time of killing casino executive Ted Binion, court documents show. "Murphy was serving 22 years to life in prison and Tabish was serving 25 years to life in prison when the Nevada Supreme Court in July reversed their murder convictions. "In court documents filed Thursday, prosecutors Christopher Lalli and Robert Daskas said they will seek life in prison without parole if the pair are convicted again of killing Binion, a 55-year-old millionaire whose family owns the Binion's Horseshoe Hotel & Casino in downtown Las Vegas. "…Murphy's lawyer Herb Sachs accused prosecutors of trying to unfairly penalize his client. "…Murphy's former lawyer, John Momot, said he doubted that increasing the sentence for conviction in a retrial would be legal. "…Tabish is not eligible for release. He was sentenced to additional prison time for the kidnapping, beating and extortion of Leo Casey, whom prosecutors said Tabish wanted to give up an interest in a gravel pit the two owned…" |
