Philippine Court Asked to Reverse Gambling Ruling16 February 2004PHILIPPINES – As reported by the Manila Times: "The Sports and Games Entertainment Corp. (SAGE) has asked the Supreme Court to reverse its January 14 decision declaring null and void the authority granted to it by the Philippine Amusement and Gaming Corp. (Pagcor) to set up sports betting stations and on-line gaming in the country. "In a 28-page motion for reconsideration, SAGE, through its lawyers led Efrenilo Cayanga, claimed that the Court erred in nullifying the authority granted by Pagcor to SAGE in 1998 without looking into the nature of the agreement 'which is in accord with the conferred powers to Pagcor by virtue of Presidential Decree 1869.' "Cayanga said SAGE has already spent P500 million in the acquisition of equipment and in providing the necessary hardware and software for the establishment of the network outlet. "…Cayanga said the Court committed a mistake when it concluded that Pagcor 'shared' its franchise when it allowed SAGE to operate gaming on the Internet. "…Cayanga argued that Pagcor is authorized under PD 1869 to enter into an agreement for the purpose of insuring the efficient operation of its franchise over gambling casinos, clubs and other recreation or amusement places, sports and gaming pools…" |
