Pataki Optimistic About Court Decision

NEW YORK – As reported by the Albany Times Union: "The Appellate Division's unanimous opinion that the state's video gambling program is illegal represents a 'positive ruling' that won't disrupt plans for lottery casinos across the state, Gov. George Pataki said Monday.

"Yet when the Senate Republicans return to the Capitol next week, fixing the video lottery terminal law before the Court of Appeals reviews the constitutionality of the video lottery terminals, or VLTs, may be on the agenda, said Majority Leader Joseph Bruno.

"…In a separate briefing, Pataki said his plan to get education funding from new VLT parlors won't be hurt by the court decision.

"'It's a positive ruling in the sense that it did declare constitutional the use of VLTs in New York state,' he said.

"…Pataki, who proposes up to eight more VLT parlors, is relying on VLT revenues to help pay for education costs expected to grow by billions of dollars because of a court mandate to fix New York's school-aid formula.

"However, the state constitution says that proceeds from VLTs, run through the Division of Lottery, must go to education, the appeals court ruled…"
