Oregon Court Hears Racino Document Case2 December 2003OREGON – As reported by the Portland Herald: "The state's Supreme Court justices questioned the lawyer for racino developer Shawn A. Scott on Monday about how documents collected in a state background check would harm his client. "The justices also peppered an assistant attorney general with questions about why the Department of Agriculture believes it has authority to release the documents after one of its agencies previously determined they were confidential. "The documents include information on the sale of Bangor Historic Track stock to Scott's company, Capital Seven; e-mails between Scott's lawyers and the state Attorney General's Office; and corporate income tax returns. "They also include letters and license applications pertaining to Scott and various companies, obtained from gaming and other state agencies in Nevada, Louisiana, New York and South Carolina where Scott has done business. "Five of the seven justices on the state's highest court heard arguments for and against blocking the state's release of the documents while Scott appeals a lower court decision that would have made the records accessible to the public last week. "…The racing commission is scheduled to decide later this month whether to grant Scott and other Bangor Historic Track owners a racing license. Without a license, the track operators can't conduct racing or install slot machines at the track…" |
