New York Court Ends Legal Challenge

NEW YORK – As reported by the New York Business Review: "The U.S. Supreme Court on Monday effectively ended the legal challenge to the expansion of gambling the state approved in New York state in October 2001.

"Without comment, the court declined to hear an appeal of a New York state Court of Appeals' ruling this year that upheld almost all of the new gambling ventures approved by the Legislature and governor in 2001.

"That gambling legislation authorized the state to enter the multi-state Mega Millions lottery game, Indian tribes to open up to five new casinos and for gambling halls featuring slot machine-like video lottery terminals to be set up at some horse-racing tracks, including the former Saratoga Harness track in Saratoga Springs.

"In its chief finding, the Court of Appeals said federal law superseded New York state's constitutional prohibition against commercial gambling…"
