New Mexican track move investigated

NEW MEXICO -- As reported by the Santa Fe New Mexican: "The state Racing Commission is hiring an attorney to examine the Downs at Albuquerque's proposal to move to Moriarty in time for the 2009 racing season.

"Commission Director Julian Luna said the commission hopes to sign a contract with Albuquerque attorney Daymon Ely by Monday. Luna said the lawyer will look at issues surrounding the Downs' application, including whether the proposed move would use up the state's only remaining slot for something it is calling a new racino -- a combination horse racetrack and casino.

"...New Mexico has five racinos -- in Albuquerque, Farmington, Sunland Park, Hobbs and Ruidoso. The state cannot license more than six racinos under new gaming compacts between the state and several American Indian tribes with casinos.

"...The Downs at Albuquerque, located at the state fairgrounds, last week filed an application asking the Racing Commission to renew its current license for the proposed Moriarty location for the 2009 racing season. Such a move would be unprecedented, Luna said..."
