Nevada Court Questions Detention of Pro Gambler19 December 2003CARSON CITY, Nevada – As reported by the Associated Press:"The Nevada Supreme Court's chief justice raised questions Thursday about the authority of a state Gaming Control Board agent to hold a professional gambler beyond the one hour permitted to police, under state law, without making an arrest. "Chief Justice Deborah Agosti asked Deputy Attorney General Antonia Cowan to explain how the circumstances of Steve Bernier's case -- being handcuffed, searched, threatened with prosecution and interrogated for more than three hours at a Las Vegas resort -- complied with the law. "…While there was no immediate ruling from the court, Agosti said Bernier was never told he was under arrest. "…Bernier was playing a bank of slots where casino staffers, through a programming error, had reversed credits that gamblers earned while playing $100 machines and $5 machines…" |
