Nevada Bills on Seizing Property and Private Gaming Signed by Governor

CARSON CITY, Nevada –– As reported by the Las Vegas Review-Journal: “A bill establishing a higher legal standard before police can seize property from people accused of crimes, and another authorizing the creation of exclusive gaming salons within casinos to cater to publicity-shy high rollers were signed into law Monday by Gov. Kenny Guinn.

”…The new law toughens the standard for seizing assets. A judge would have to decide there was `clear and convincing’ evidence that the property was used in -- or constituted the ill-gotten gains of -- criminal activity before it could be seized. Now it is much easier to show `preponderance of evidence.’

”…The change requires that 70 percent of the net proceeds of forfeitures in excess of $100,000 annually be given to public schools for textbook and technology purchases. All of the money now is retained by law enforcement jurisdictions that seize the assets.

”The salon bill was supported by the state Gaming Control Board, and is viewed by the gaming industry as another tool to allow Nevada to compete with other gaming jurisdictions around the world that offer private salon gaming.

”Representatives of two Las Vegas casinos testified at a Senate hearing on the salon bill that there are a few hundred international gamblers who bet vast sums of money at casinos around the world, but they won't come to Las Vegas because they cannot gamble out of the public eye. Nevada law had required all gaming operations to be conducted in public.”
