Man Files Lawsuit Against Borgata

ATLANTIC CITY, New Jersey – As reported by the Press of Atlantic City: "A Delaware man has filed an age and race discrimination lawsuit against the Borgata Hotel Casino & Spa claiming he was denied a job as a mechanic because recruiters were looking for candidates who were 'fun, fast, friendly, fresh and focused.'

"Herbert Nelson was 58 when he applied online in January 2003 for a job in heating, ventilation and air-conditioning as a repair mechanic, and a position in management. Nelson, who has more than 24 years of experience in the field, got an interview.

"On February 14, 2003, Nelson met with the Borgata's Facilities Supervisor Mark Peuntes. Nelson scored high on the application, and Puentes marked in his interview notes that he was a 'pleasant person' that had been working in the field for many years. However, Nelson received no request to come back for a second interview, according to the lawsuit filed in federal court in Camden Sept. 21 under the Age Discrimination in Employment Act and Civil Rights Act.

"…Nelson, who is black, said the Borgata refused to hire him because of his age and race. The casino went ahead and hired seven young, less-experienced white applicants, for the heating and air conditioning positions, the suit said…"
