Judge Gene Porter ordered the parties to try and settle the dispute through court-supervised mediation, delaying a decision on the seizure request until at least Jan. 28.

FSE President Mark Paris noted in a court filing that the Horseshoe initially claimed it didn't have the financial wherewithal to pay its past due payments.

"Based upon all the information available to me, I believe that the Horseshoe has no intention of paying the (FSE) any of the past due assessments owed," Paris wrote. "If the Horseshoe's assets are not (seized), the (FSE) faces a virtual certainty that the Horseshoe will dispose of any remaining monies voluntarily, or that a bankruptcy may be filed before a final judgment is rendered."

CHARLIE GROWS: Carl Icahn's Arizona Charlie's East broke ground last month on a $5 million expansion to the Boulder Highway locals casino.

The new three-floor structure is slated to open this summer, and will include a 500-seat bingo hall and a race and sports book.

The expansion will also allow Arizona Charlie's East to add about 175 slot and video poker machines to its existing 783-device inventory.

"The expansion reflects the confidence Icahn gaming properties have in the Las Vegas locals gaming market," company spokesman Mike Gilmartin said.
