Land Claim Settlement Bill Introduced to New York State Legislature

9 June 2005

MONTICELLO, New York -- (PRESS RELEASE) -- Empire Resorts, Inc. (NASDAQ: NYNY) announced today that a bill has been introduced into the New York State Legislature that addresses land settlement claims by the Mohawk tribe of New York. While such legislation does not include any provisions for the Cayuga Nation of New York, the bill represents progress towards developing the Catskills as a casino resort destination.

Empire believes that its partner, the New York Cayuga Nation, is well positioned and would be a logical choice for land settlement and, thus, an Indian casino in the Catskills. As noted by Governor Pataki, "We remain committed to resolving the Cayuga and Oneida Indian land claims, so that we can protect landowners in Central New York and avoid further costly and disruptive litigation."
