Kansas court upholds casino law

2 July 2008

KANSAS -- As reported by the Wichita Business Journal: "In a big win for gambling supporters, the Kansas Supreme Court on Friday upheld the constitutionality of a 2007 law that allows for four large casinos to be built across the Sunflower State.

"The ruling permits the competition among three casino developers to continue in Sumner County, where a large facility now is likely to be built in Mulvane or Wellington.

"At issue was whether the proposed casinos would adhere to a Kansas Constitution requirement that gambling be owned and operated by the state. Developers will own the buildings and equipment in each casino. They also will run the casino's operations.

"The state, however, says it controls how the revenue from the casinos are distributed and has several other critical roles of oversight.

"...The court noted the state will receive gambling revenue, own casino software, monitor electronic games and have the authority to enter into management contracts and supervise casino managers..."
