Indiana Man Faces Prison for Selling Gambling Devices

PLYMOUTH, Indiana – As reported by the South Bend Tribune: "A Fort Wayne businessman who police say provided illegal gambling devices to a local bar now could spend up to three years behind bars.

"A jury found Phillip A. Black, 36, of Linden Groove Drive, Fort Wayne, guilty of promoting professional gambling, a Class D felony, in Marshall Superior Court II Thursday.

"…Officers from the Indiana State Excise Police went to Brother's Nite Club, 414 W. LaPorte St., Plymouth, in December 2002 to investigate a complaint, according to testimony from two excise officers. There, police say they found two gaming devices, housed in simulated-wood consoles resembling coin-operated video game machines.

"…Al Bustamante, who owned the bar at the time, testified only one company -- J.T. Consulting of Fort Wayne -- had been servicing his entertainment machines, which also included juke boxes and pool tables, for several years. Bustamante also testified he paid the $500 fine leveled by the excise police because it was too much hassle to fight it.

"…Attorney Tom Black, who represented Phillip Black, argued there was no evidence anybody actually gambled at the machines…"
