Former worker files complaint against Casino Aztar

INDIANA -- As reported by the Evansville Courier-Press: "A man recently fired by Casino Aztar has filed a federal complaint alleging violations of the Family and Medical Leave Act.

"He is accusing his supervisors of harassing him for taking time off to adopt a child.

"...Dennis DuCiaome of Newburgh worked at the casino from November 1995 until he was fired this spring.

"...But according to his complaint in U.S. Southern District Court, the trouble began June 14 when DuCiaome applied for qualifying leave in order to complete the adoption of a special-needs child in California.

"In the four-page complaint against Aztar Indiana Gaming Company LLC, DuCiaome claims his supervisor immediately questioned why he needed the time off.

"...One month later, DuCiaome claims that he was passed over for a promotion, even though his tenure and qualifications put him in line for the position.

"...DuCiaome alleges that his harassment by one manager — who under the lawsuit guidelines is not named specifically as a defendant in the complaint against Aztar — escalated over time.

"...DuCiaome's firing came weeks after he again applied for leave in March. A doctor completed and certified the paperwork explaining DuCiaome needed to tend to his children's medical needs.

"...Aztar cites falsified food vouchers

"On April 24, the company fired DuCiaome, citing the alleged falsifying of food vouchers..."
