Filipino Court Dismisses Action Against Casino

9 December 2003

BAGUIO CITY, Philippines – As reported by the Manila Times: "The Baguio City Regional Trial Court (RTC) dismissed for lack of cause for action Tuesday the petition of a group of lawyers to stop the implementation of a city council resolution allowing the establishment and operation of a casino inside the Camp John Hay military reservation.

"On motion from both parties, RTC Branch 5 Judge Antonio Esteves denied and dismissed the petitioners' plea for the issuance of a temporary restraining order (TRO) to stop the casino's establishment.

"…Esteves explained that the city council resolution constituted merely an expression of the sentiments of its members regarding the controversial John Hay casino.

"…Esteves also said the petitioners failed to show that they stand to suffer grave injustice and/or irreparable injury if the TRO is not issued.

"…On November 4, the city council amended the no-gaming policy inside Camp John Hay, which is contained in the contract between the Baguio city government and the BCDA…"
