Dutch Gaming Authority adds guidelines on ban of untargeted advertising

(PRESS RELEASE) -- The Dutch Gaming Authority is publishing new guidance on the ban on untargeted advertising. With this guidance, the Ksa provides licensees of remote gambling with further explanation and practical tools to comply with the legal requirements applicable to online advertising, with the aim of better protecting vulnerable groups against gambling advertising.

Since the introduction of the ban on untargeted advertising, providers of online gambling are only permitted to advertise via the internet and on-demand media services under strict conditions. In practice, it appears that these conditions raise questions among license holders.

With the new guidance, the Ksa therefore clarifies how these conditions must be interpreted and applied. The guidance addresses, among other things, advertising via external platforms and third parties, offering a genuine opportunity to refuse advertising, and the manner in which providers must record and substantiate their efforts and measurement results. The underlying principle is that advertising for online gambling does not reach vulnerable persons. In some cases, this may mean that a provider must refrain from advertising on a specific platform.

In addition, the guidance contains practical guidelines and an extensive Q&A, based on questions from the field and signals from supervision. With this, the Ksa aims to contribute to careful and consistent compliance with the ban on untargeted advertising within the online gambling market.
