Court Upholds New York Tribal Casino Ruling5 May 2006NEW YORK – As reported by the WNYT News: "New York's Court of Appeals says the Turning Stone Casino is operating illegally. The Court of Appeals said the compact between the state and the Oneida Indian Nation which allows the casino is invalid. But the tribe says it's doing nothing illegal and that Turning Stone casino will stay open. "The Turning Stone Casino brings in millions of dollars and thousands of visitors each year "On Thursday the court refused to hear an appeal by the Oneidas and upheld previous rulings, saying the compact between the state and the tribe that allows the casino is invalid because it was done so without the approval of the state Legislature. "'The court of appeals a couple of years ago ruled you needed to have legislative authorization . They never obtained that legislative authorization,' said Neil Murray, the attorney who filed the lawsuit. "…An Oneida spokesperson insists the nation's compact was approved by the secretary of the interior and is valid under federal law and that nothing in state court can change that…" |
