County won't appeal Cowlitz casino ruling

WASHINGTON – As reported by the Columbian: "Clark County has decided not to take a dispute over the proposed Cowlitz casino all the way to the Washington Supreme Court.

"County commissioners, after meeting privately with their attorneys Wednesday, voted unanimously not to appeal the Washington Court of Appeals decision regarding the 2004 memorandum of understanding between the county and the Cowlitz Tribe.

"The agreement spells out how the casino project would be developed on a 152-acre site two miles west of La Center, including a provision that the tribe must use water from Clark Public Utilities.

"The Court of Appeals pointed out that county policy allows public water to be provided only to developments that comply with its growth plan. The growth plan does not permit gambling…"
