Comped meals settlement approved by Nevada board

A decade-long fight over taxation of free meals provided by casinos to patrons and employees came to an end Tuesday.

The Associated Press reports the Nevada Board of Examiners approved the final piece of a settlement, authorizing $4.5 million to be paid back to casinos that once paid the tax but are no longer in business.

The issue dates back to a 2003 lawsuit by a Sparks casino, which argued it shouldn't have to pay taxes on comped meals. In 2008, the Nevada Supreme Court ruled that comped meals did not require a use tax, but the question of whether such meals are subject to sales tax was left unresolved.

State lawmakers this year approved a bill, AB506, which absolved the state of a potential $233 million tax liability.

"This settles the matter unless a future legislature changes the law," state budget director Jeff Mohlenkamp told reporters.
