California Court Dismisses Ballot Lawsuit Again

4 June 2004

SACRAMENTO, California – As reported by the San Diego Union-Tribune: "The California Supreme Court has refused for a second time to hear a lawsuit that seeks to remove a gambling initiative backed by cardrooms and racetracks from the November ballot.

"…The lawsuits were filed separately by the Agua Caliente band of Palm Springs and another group of big gambling tribes. A state appellate court earlier refused to hear either challenge. Agua Caliente appealed to the state's high court.

"…The lawsuits contend the initiative violates the state's constitutional limit of one subject per ballot measure and a prohibition against amendments that benefit a select group of private corporations…"
