Buffalo Waits for Judge's Casino Ruling

BUFFALO, New York – As reported by the Buffalo News: "Mayor Anthony M. Masiello and a group of Buffalo businessmen seeking to force the Seneca Nation to build its casino in Buffalo may know within a week or so whether a state judge will bar the nation's plan for a Cheektowaga site.

"State Supreme Court Justice Joseph G. Makowski Friday reserved decision on the bid by Masiello and a business group led by developer Carl Paladino to bar the proposed transfer to the Senecas of 57 acres owned by the Uniland Development Corp. near the Buffalo Niagara International Airport.

"After a three-hour hearing at which attorneys for the state, Cheektowaga and Uniland argued that the lawsuit was premature because the Senecas first need federal government approval for any casino, Makowski promised to issue an expedited ruling.

"…Michael B. Powers, who represents CONCERN, a grass-roots group opposed to the Cheektowaga casino deal, told the judge the State Legislature's authorization dealt only with locating a casino in the city.

"Powers told the judge that under the terms of Gov. George E. Pataki's deal with the Seneca Nation, Buffalo, which is now under a state control board, would lose an anticipated $100 million in casino-generated revenue if the casino is built in Cheektowaga…"
