Appeals Court Rejects Wisconsin Casino

MILWAUKEE, Wisconsin – As reported by the Milwaukee Journal Sentinel: "A federal appeals court Thursday delivered one more dose of bad news to the owners of the defunct Hudson dog track and three Chippewa tribes that had hoped to convert it into a casino.

"A three-judge panel of the 7th Circuit Court of Appeals in Chicago upheld a lower court ruling saying then-Gov. Scott McCallum was within his legal power in 2001 when he vetoed a casino deal.

"But track owner Fred Havenick plans to continue his 14-year casino quest, and he will fight Thursday's ruling, said Bob Friebert, Havenick's attorney.

"…The tribes and Havenick asserted that allowing a governor to veto a federal casino decision was unconstitutional.

"…Havenick closed the Hudson dog track in 2001 after McCallum's action, saying he'd lost some $32 million on the operation."
