AG says smoking ban will hold up in court

CONNECTICUT -- As reported by the Hartford Courant: "Attorney General Richard Blumenthal, in a legal opinion issued today, said a ban on smoking at Foxwoods Resort Casino and Mohegan Sun could withstand any challenge in federal court by the owners of the tribal casinos.

"But he warned that the process could be long and expensive, and encouraged the General Assembly to open negotiations with the Mashantucket Pequot Tribe, which owns Foxwoods, and the Mohegan Tribe on the issue of smoking at the casinos.

"Blumenthal said leaders of both tribes have said they are willing to meet with state officials about smoking.

"...According to Blumenthal's opinion, even though Foxwoods and Mohegan Sun are on sovereign tribal land, the agreements between the tribes and the state require the tribes to adopt health standards at the casinos that are 'no less rigorous than state public health standards. A smoking ban would fall under that requirement, the attorney general said..."
