New Superseding Indictment Issued in BetonSports Case

Defendants in the federal case against BetonSports will be ordered to enter their pleas for a third time following the issuance of another amended indictment.

The United States government on Sept. 3, 2008, filed its second revised -- or superseding -- indictment, listing the charges against eight defendants. The number of defendants has been reduced, which is likely the cause of the third indictment.

BetonSports pled guilty in May 2007 to racketeering charges and agreed to supply witnesses and evidence in the pending cases against the co-defendants, in exchange for immunity against future related charges being brought against BetonSports directors, past or present, not already charged.

In late July 2008, three men named in the original indictment -- William Hernan Lenis, William Luis Lenis and Manny Gustavo Lenis, owners and operators of a Florida-based marketing and promotions company employed by BetonSports -- pled guilty to charges relating to the promotion of illegal Internet gambling. In exchange, the government agreed to drop all other charges against them and against Monica Lenis, William Hernan Lenis' daughter, who worked with the three men.

No arraignment date has been set for the remaining defendants, which include Gary S. Kaplan, founder of BetonSports, David Carruthers, ex-chief executive of the company, and six other individuals.

According to the superseding indictment, some of the charges may have been changed or extended. IGamingNews is awaiting further clarification from the office of Catherine L. Hanaway, the United States attorney for the Eastern District of Missouri.
