Developing: iMEGA-UIGEA Battle to Continue29 September 2008
The Interactive Media Entertainment & Gaming Association -- better known as iMEGA -- today filed an appeal in its case against the United States government, challenging the constitutionality of the Unlawful Internet Gambling Enforcement Act. "This is a very simple argument on which we ask the court to overturn this law," Joe Brennan Jr., the chairman and chief executive of iMEGA, said in a prepared statement. "UIGEA should be 'void for vagueness', in that Congress has not defined what an 'unlawful Internet gambling transaction' is." The association in March was granted standing to represent its members by Judge Mary L. Cooper of Federal District Court in New Jersey, but the case was dismissed on the merits of iMEGA's claims. Today's appeal was filed with the United States Court of Appeals for the Third Circuit. IGamingNews will report the full story later today.
