Correction: DOJ Responded to All Motions in BetonSports Case

10 October 2007

IGN reported on Tuesday that defendants Gary Kaplan and Penelope Tucker still had pretrial motions to which the prosecuting attorneys had not responded.

According to court documents, however, the government responded to all motions on Oct. 5, recommending that all be denied.

Kaplan, founder of the now-defunct sports betting company, is charged with 21 of 22 counts of the indictment. His attorneys filed pretrial motions on Aug. 13.

Tucker, is charged with only count one (the RICO conspiracy). In addition to entering a motion to dismiss the count, she has entered motions to suppress evidence, compel evidence and testimony and sever her trial from the other defendants. The government has recommended that each motion be denied.
