Kansas City smoking ban confusion26 August 2008MISSOURI – As reported by the Kansas City Star: "The Kansas City Health Department is cracking down on casino smokers. But one recent crack may have come down in the wrong place. "This month a city health inspector issued violation tickets to Don Thiede, security chief at Ameristar Kansas City Casino and Hotel, who allegedly permitted smokers to puff away unlawfully in the casino's public concourse areas. "But the city ordinance approved by voters April 8 seems to permit smoking there. "The ordinance prohibits smoking in casino restaurants and bars, but allows tobacco use on the casino floor, which the ordinance defines as including 'paths of ingress and egress immediately adjacent to and contiguous with the excursion gambling boat.' "Ameristar vice president Troy Stremming said he's hoping somebody at City Hall rereads the ordinance soon and agrees there was no violation. "...Health department's director of environmental health, disagrees. "...He agreed the dispute centers on whether smoking is allowed along the casino's indoor concourse, a winding brick 'streetscape' that links a hotel, restaurants, nightclubs, bars, a movie theater, an event center, a non-gambling game arcade and a child day care facility..." |
