Iowa board to consider legal action

COUNCIL BLUFFS, Iowas -- As reported by the Omaha World-Herald: "Up to now, Pottawattamie County officials have stayed out of the fray involving a proposed Indian casino in Carter Lake — but that could change next week.

"The Pottawattamie County Board will consider whether to take legal action to stop the casino, either by joining a lawsuit or filing its own. The matter is scheduled to be discussed Monday morning, and a vote could come on Wednesday.

"Representatives of Council Bluffs' three casinos have expressed concerns about the proposed casino, several County Board members said, but so far have not taken a public stand on whether a new one should be built in Carter Lake.

"A new casino would mean increased competition for casinos that have seen decreased revenue in recent months. And local governments and communities might suffer if the Ponca-run casino did not pay the same taxes and make the same charitable contributions as the existing ones.

"The State of Iowa, the City of Council Bluffs and Pottawattamie County all receive taxes from gambling revenue — taxes that the Ponca Tribe of Nebraska would not be obligated to pay.

"Larry Wright Jr., Ponca chairman, has defended the tribe's right to pursue gambling, saying Iowa has gambling deals with three other tribes..."
