West Virginia Seeks to Get Video Poker Suit Tossed26 July 2001WEST VIRGINIA – July 26, 2001-- As reported by the Associated Press: "The state has filed a motion to dismiss a lawsuit challenging the constitutionality of a new video poker law. "…The lawsuit, filed last week, argued that the law places unfair restrictions on who is allowed to own machines because it requires machine owners to be West Virginia residents for at least four years. "…But the state's motion argued that the law's residency requirements are reasonable. "…`The state of West Virginia has long prohibited private gambling through video poker, but its prohibition has been woefully ineffective,' the motion said. `The state has decided that offering a controlled, limited and legal form of video poker as part of the state's existing lottery system would make illegal gambling a less profitable (and less attractive) undertaking, and (would) raise revenues solely needed for a number of worthwhile public purposes.'" |
