Tigua Tribe Dealt Setback in Attempt to Keep Casino Open5 November 2001EL PASO, Texas –- As reported by the Associated Press: ``A federal judge has denied the Tigua Indian tribe's request for a new trial and for amending the judgment ordering Speaking Rock Casino to shut down by Nov. 30. ``The Tiguas had hoped that the judge would allow the casino to continue operating while the case goes through the appeals process. ``The ruling by U.S. District Judge Garnet Thomas Eisele, issued Friday, stated, 'The Court believes it is unnecessary, and indeed, that it would be unwise to change the injunction in anticipation of possible future actions to engage in legal gambling on the Tribe's reservation.' ``The same judge ordered last month that the casino be closed on Nov. 30 because it violated Texas gambling laws. ``Tigua Gov. Albert Alvidrez said the tribe will continue with the appeals process. ``…Tigua spokesman Marc Schwartz said the tribe was "extremely disappointed" with the judge's ruling. ``…The tribe contends the casino is legal under Texas law because of the state's lottery act..." |
