South Carolina Challenge to Video Poker Ban Fails

WASHINGTON, D.C. -- Nov. 27, 2000 -- As reported by the Associated Press: "Gambling operators in South Carolina lost a Supreme Court challenge Monday to the state's new ban on possession of video gambling machines.

"...Video gambling became a multibillion-dollar business in South Carolina during the 1990s as the result of state laws and court rulings.

"In June 1999, state legislators approved a bill that banned video gambling unless voters decided in a referendum to allow the gambling to continue. The state Supreme Court later threw out the referendum but kept the ban, in effect killing the industry.

"The ban on video gambling, which took effect July 1, also made it illegal to possess video gambling machines.

"...The ban on possessing the machines was challenged in state court by the Westside Quik Shop in Greenville, S.C., and the owners of another South Carolina video gambling business called Winner's Pot of Gold Hot Spot.

"...In the appeal acted on Monday, the companies' lawyers said the `legislative label of 'contraband' should not cancel property rights guaranteed by the Constitution..."
