Slots at New Mexico Racetracks Could Jeopardize Tribal Deals

SANTA FE, New Mexico –March 27, 2001 – As reported by the Albuquerque Journal: "An Indian gambling official said Monday it's unclear what New Mexico tribes with casinos might do if Gov. Gary Johnson signs a bill to allow more slot machines at non-Indian racetracks.

But Frank Chaves, executive director of the New Mexico Indian Gaming Association, contended that expansion of non-Indian gambling could threaten approval of a new state-tribal compact by the U.S. Department of Interior.

…The proposed compact, which also has to be approved by the Interior Department, calls for a two-tier revenue sharing plan capped at 8 percent — a reduction from the current 16 percent rate. New Mexico Indians have agreed to revenue sharing with the state partly in exchange for limited exclusivity in gambling, or limits on non-Indian gambling.

…Chaves said in a telephone interview Monday that the 11 tribal casinos are committed to seeing the new compact approved by Interior.

…Longtime gambling critic and former state senator Victor Marshall said increasing slot machines at racetracks would violate the state's 1997 gambling compact with New Mexico Indians, as well as jeopardizing the new compact…"
