New York Tribal Casinos Still Dicey

ALBANY, New York –– As reported by the New York Post: "The opening of three Indian-run casinos in the Catskills is no sure bet, even with last week's authorization by the state Legislature.

"Legal challenges, detailed governmental negotiations and federal approvals all could seriously delay, if not kill, potential projects, sources say.

"…The biggest obstacle will likely be the courts, which will be asked to decide if the slot machines authorized in the legislation are legal under New York state's Constitution.

"…If the slots are ruled unconstitutional, the casinos could still be built with video gaming machines install instead.

"But with the electronic versions of slot machines classified differently under existing law, the state would be unlikely to derive any revenue from casinos fitted exclusively with video betting games.

"…Other delays could come from the need for Indian tribes to negotiate detailed compacts with Pataki and also receive approval from the federal government.

"…Located just 90 miles from New York City, the Catskills hope to capitalize on the millions of day trips New Yorkers take each year to casinos..."
