Judge Orders Attorneys to Agree on Facts1 August 2003MADISON, Wisconsin – As reported by the Associated Press: “A judge asked attorneys Thursday to reach agreements on disputes over evidence in a lawsuit Republican lawmakers filed challenging the governor's power to sign tribal gambling compacts. “Reserve Judge Gordon Myse has been asked by the state Supreme Court to prepare a report on the facts in the lawsuit and make a recommendation on whether the justices should take up the case directly rather than requiring it to go through the circuit court first. “…Republicans, who control the state Legislature, filed the lawsuit after Democratic Gov. Jim Doyle signed a compact with the Forest County Potawatomi earlier this year. It allows the tribe to offer new games and removes restrictions on its casinos. The compact has no expiration date. “In return, the tribe expects to pay the state about $340 million over the next decade. “Republicans have urged the Supreme Court to take up the case directly, arguing there are pressing issues that need to be decided quickly. Among them, the lawsuit claims the Potawatomi compact violates a 1993 amendment to the state constitution restricting gambling expansions. “…Myse set an evidentiary hearing for Aug. 8, but asked Baldwin and Greene to meet before then to try to reach agreements on the assertions and establish the sources for them…” |
