Icahn Casinos Hit with Trademark Infringement Suit

19 February 2003

ARIZONA -- Station Casinos Inc. filed a trademark infringement lawsuit in U.S. District Court against financier Carl Icahn's Arizona Charlie's East hotel-casino at 4575 S. Boulder Highway and Arizona Charlie's hotel-casino at 740 S. Decatur Blvd.

Station, which said it owns the "Bounce Back" mark, wants an order to stop Arizona Charlie's from using the phrase and to delete all references to the trademark in its advertising.

Bounce Back refers to a cash bonus promotion at Arizona Charlie's called Real Cash Bounce Back Giveaway, where players can cash in between 500 points and 2,500 points they've earned in slot or video poker games for up to $25. The promotion started Feb. 1.

Michael Gilmartin, spokesman for Icahn's gaming interests in Las Vegas, including the Stratosphere hotel-casino, declined comment on the allegations.
