Gaming Firm Sues Mississippi Regulators29 April 2002MISSISSIPPI – As reported by the Mississippi Clarion-Ledger: "A&A Amusements Inc. is suing the Mississippi Gaming Commission in U.S. District Court in Greenville, challenging Mississippi law on illegal gambling devices. The commission wants the case dismissed. No hearing date has been set. "Greenville-based A&A Amusements contends state law is unconstitutional in classifying as illegal video games that might be lawful in any other circumstances. The company wants the state barred from enforcing the law until a ruling is made. "…[Company owner William Fulwood] argues in court papers that bingo halls are allowed to operate video games similar to what he offers. Bingo is legal in Mississippi and regulated by the Gaming Commission. "…In its motion for dismissal, Assistant Attorney General Joel R. Jones said the commission is protected from the lawsuit under sovereign immunity. "The state Supreme Court has found such machines illegal under existing law. Most recently, the court said last September that amusement machines are illegal slot machines because they have an element of chance and return a thing of value…" |
