Former Employer Takes Foxwoods to Supreme Court3 March 2003CONNECTICUT – As reported by the Connecticut Day: "A former table-games supervisor at Foxwoods Resort Casino who says he was fired for taking time off to care for his sick mother is asking the U.S. Supreme Court to rule on his case. "Westerly resident Joseph Chayoon said he is still seeking his day in court after the U.S. District Court and the Second Circuit Court of Appeals dismissed the case for lack of jurisdiction. The Mashantucket Pequot Tribal Nation, which owns Foxwoods and has its own court system, claimed sovereign immunity in federal court and asked the courts to dismiss the case. "Chayoon said he was fired in 2000 after taking 11 weeks off to care for his mother, who is in her 80s and lives in Israel. Chayoon worked at Foxwoods since 1992 and took time off each spring or summer for six years to care for his mother "…He said a casino official offered his job back if he promised never to take another family medical leave, but he refused. "…His submission to the Supreme Court asks questions about everything from the obligation of Foxwoods Resort Casino to honor the Family Medical Leave Act to the legitimacy of the Mashantucket Pequots. "…Chayoon is seeking nearly $14 million for lost pay, benefits and bonuses, mental anguish and deterioration of his health. He said he is suing the entire Mashantucket Pequot tribal council as well as 18 Foxwoods employees…" |
