Failed Christmas Island Resort Staff May be Compensated7 January 2003AUSTRALIA – As reported by the West Australian --Long-Suffering former employees of Christmas Island Resort Pty Ltd could be paid after five years of legal battles over the collapsed casino and resort company. "Federal Court-appointed liquidator and receiver Jeffrey Herbert said yesterday he hoped to pay entitlements to about 280 employees by the end of March. "The PPB Ashton Read partner said the $2.2 million (US$1.26 million) payment would be made provided there were no complications and no new legal challenges from aggrieved major shareholder Robby Sumampow. "…As it stands, there is likely to be minimal joy for Jakarta-based Mr Sumampow when unsecured creditors are paid out after the process of determining employee claims is finalised. "…Mr Herbert said there was a vague clause in the employees' award regarding penalties for the company wilfully refusing to pay wages. "He said his lawyers had difficulty understanding the clause but they had provided an interpretation that had been agreed to by employee representatives and about $20,000 had been earmarked to pay penalties…" |
